7. Your Texas Privacy Rights

The Texas Data Privacy and Security Act (Texas Business and Commerce Code, Chapter 541) gives Texas residents rights over their personal data. The Act generally does not apply to businesses that qualify as small businesses under U.S. Small Business Administration standards, and it covers individuals acting in a personal or household capacity rather than in a business or employment role. Cyber One Solutions may qualify for these exemptions. Whether or not the Act applies to a particular request, we voluntarily honor the following requests from Texas residents:

  • Access. Confirm whether we process your personal data and obtain a copy of it.
  • Correction. Correct inaccurate personal data, taking into account the nature of the data and why we process it.
  • Deletion. Delete personal data you provided to us or that we obtained about you, except where we must keep it to meet a legal obligation.
  • Portability. Receive the personal data you provided to us in a portable and, where technically feasible, readily usable format.
  • Opt out of targeted advertising. When you allow Advertising cookies, the Meta Pixel, Google Ads remarketing, and Microsoft Advertising tags use information about your visits to show you our ads on other websites and apps. That is targeted advertising. You can opt out at any time by choosing Reject or turning off Advertising in , or by emailing us.
  • Opt out of sale and profiling. We do not sell personal information for money, and we do not use personal data for profiling in furtherance of decisions that produce legal or similarly significant effects. If you ask us to, we will also treat your request as an opt-out of any disclosure that a privacy law may treat as a sale.
  • Non-discrimination. We will not deny you services, charge you a different price, or provide a different quality of service because you exercised these rights.

How to submit a request. Email [email protected] with the subject line "Privacy Request," or call (866) 998-7691. Tell us which request you are making. You do not need an account with us. We may ask for information reasonably necessary to verify your identity before we act. You may use an authorized agent to submit an opt-out request on your behalf, and we may ask for proof of the agent's authority.

Response time. We will respond within 45 days after we receive your request. If we reasonably need more time, we may extend that period once by up to 45 additional days. If we do, we will tell you within the first 45 days and explain why. We do not charge a fee to process a privacy request.

Appeals. If we decline to take action on your request, we will tell you why and how to appeal. To appeal, email [email protected] with the subject line "Privacy Request Appeal" and describe the decision you are appealing. We will respond in writing within 60 days after we receive your appeal and explain any action taken or not taken and the reasons. If we deny your appeal, you may submit a complaint to the Texas Attorney General.
