Trademark Notice

Cyber One Solutions, LLC owns the following federally registered trademarks with the United States Patent and Trademark Office (USPTO):

Both marks are registered in connection with IC 037 (repair or maintenance of computers), IC 038 (internet services), and IC 042 (technology services), and are owned exclusively by Cyber One Solutions, LLC, a Texas Limited Liability Company.

The name CYBER ONE SOLUTIONS, the CO CYBER ONE SOLUTIONS logo and design mark, and all associated trade names, service marks, taglines, and trade dress used by Cyber One Solutions, LLC are protected under the Lanham Act (15 U.S.C. §§ 1051 et seq.) and applicable Texas law. These marks may not be used, copied, imitated, or incorporated, in whole or in part, without the express prior written authorization of Cyber One Solutions, LLC.

Prohibited uses include, without limitation:

• Using our name, logo, or any confusingly similar variation in commerce without authorization.
• Incorporating our marks into domain names, social media handles, business names, or advertising materials.
• Using our marks in a manner that falsely suggests affiliation, sponsorship, or endorsement by Cyber One Solutions.
• Reverse-engineering, reproducing, or creating derivative works based on our design marks or trade dress.
• Using our marks in meta tags, keywords, or search engine optimization in a deceptive or unauthorized manner.

Cyber One Solutions, LLC actively monitors and enforces its trademark rights. Any unauthorized use of our registered marks or trade names constitutes trademark infringement and unfair competition under federal and Texas state law, and may subject the infringing party to civil liability including:

• Injunctive relief to immediately cease all infringing use.
• Disgorgement of profits derived from the unauthorized use.
• Actual damages, including lost revenues and harm to brand reputation.
• Statutory damages and, in cases of willful infringement, enhanced damages up to three times actual damages under 15 U.S.C. Section 1117.
• Recovery of attorney's fees, court costs, and all litigation expenses.

All enforcement actions will be pursued at the infringer's sole expense. Cyber One Solutions, LLC reserves the right to recover all reasonable attorney's fees and costs incurred in investigating, sending cease-and-desist correspondence, and litigating any infringement claim.

Any legal action or proceeding arising out of or relating to the unauthorized use of Cyber One Solutions, LLC's trademarks or trade names shall be brought exclusively in the state or federal courts of competent jurisdiction located in Harris County, Texas. The infringing party irrevocably consents to personal jurisdiction and venue in Harris County, Texas for the resolution of any such dispute.

These rights are governed by the laws of the United States (Lanham Act, 15 U.S.C. §§ 1051 et seq.) and the State of Texas, without regard to conflict of law principles.

Authorized third-party use of our trademarks, including by media, press, or authorized partners, must comply with any trademark usage guidelines provided by Cyber One Solutions, LLC. No license, right, or permission to use our marks is granted by mere reference to this notice or by any other means except a separate, duly executed written license agreement signed by an authorized officer of Cyber One Solutions, LLC.

The failure of Cyber One Solutions, LLC to enforce any provision of this notice or to act upon any infringement at any particular time shall not constitute a waiver of its trademark rights or its right to enforce such rights at any subsequent time against the same party or any other party.
